A3 SERVICIOS DE TECNOLOGIA S.A. DE C.V. (hereinafter “A3“) is committed to protecting your privacy. This privacy notice sets out the terms on which the atix app and website https://app.atix.digital uses and protects the information that is provided by its users.
Therefore, and observing the provisions of the Federal Law on the Protection of Personal Data in Possession of Private Parties and its Regulations, it is reported that A3 serves as the Responsible for the processing of your personal data, whose general data are:

By using A3’s services, you declare that you know and accept the terms and conditions contained in this privacy notice, and in accordance with the provisions of articles 1803 of the Federal Civil Code and 8, third paragraph of the Federal Law on the Protection of Personal Data in Possession of Private Parties, you expressly accept and consent for A3 to use your personal data for the purposes contained in this notice.
DEFINITIONS
PERSONAL DATA. Any information concerning an identified or identifiable natural person.
HOLDER. The natural person of legal age to whom the personal data identifies or corresponds.
APPLICATION: Refers to atix, a digital platform for electronic receipts management.
TREATMENT. The collection, use (including access, handling, exploitation, transfer or disposal of personal data), disclosure or storage of personal data by any means.
TRANSFER. Any communication of data made to a person other than the controller or data processor.
ARCO RIGHTS. Rights of access, rectification, cancellation and opposition.
TACIT CONSENT. It will be understood that the owner has consented to the processing of the data, when the Privacy Notice has been made available to him/her, and he/she does not express his/her opposition.
USER: Person who uses atix‘s services, both the application and the website.
BUSSINES ESTABLISHMENT: An individual or legal entity that hires the atix service to offer its customers the receipt of electronic receipts for purchases made with it.
ELECTRONIC RECEIPT: Receipts of purchase issued in digital format.
QR CODE: Quick response code that users can scan to download receipts in physical business establishments.
ELECTRONIC INVOICING: Process of generating electronic invoices from receipts stored in the application.
PERSONAL DATA: Information that identifies or can identify an individual, such as name, email, telephone number, among others.
RESPONSIBLE: A3 SERVICIOS DE TECNOLOGIA S.A. DE C.V., the company that decides on the processing of the user’s personal data.
DATA PROCESSING: Any operation carried out with personal data, such as collection, storage, use, circulation or deletion.
PERSONAL DATA COLLECTED
In order to comply with the purposes described, A3 may collect and process the following categories of personal data:
- Full name;
- b) E-mail address;
- c) Telephone number (mobile and home);
- d) Details of the electronic receipts (date, amount, business establishment, etc.);
- e) Billing information;
- f) Tax data (name, denomination or company name, federal taxpayer registry, tax domicile)
- g) Data related to the form of payment for the contracted services;
- h) Information on the use of the application and;
- i) User interactions and preferences.
WAYS WE COLLECT YOUR PERSONAL DATA. For the activities described in this Privacy Notice, we may collect your personal data in a variety of ways, including when you provide it directly to us in person or remotely, when you visit our website or use our online services, and when we obtain information from other sources, where permitted by law.
PURPOSE OF PROCESSING PERSONAL DATA
The personal data we collect through atix will be used for the following purposes:
a)Primary Purposes
- Service Provision: To provide the management electronic receipt service, including storage and access.
- Invoice Generation: To generate electronic invoices from receipts stored in the application and/or on the web platform.
- The generation of surveys.
- The generation of advertising. b)Secondary Purposes
- Service Improvement: To improve the quality of service, personalize the user experience, and develop new functionalities.
- Communications: To send notifications about changes to terms and conditions, app updates, promotions, and other service-related communications.
- Analytics and Statistics: To perform statistical and market analysis on the use of the application.
USE OF (SSL). The security and confidentiality of the personal data that the Data Controllers provide when contracting an A3 service or purchasing a product online will be protected by a secure server under the Secure Socket Layer (SSL) protocol, in such a way that the data will be transmitted encrypted, to ensure its integrity. To verify that you are in a protected environment, make sure that an S appears in the HTTP protocol navigation bar.
However, and despite having better technology and safer and more effective tools every day. The protection of data sent through the internet or any electronic means cannot be guaranteed 100%, so once received A3 will do the pertinent to safeguard the information provided by the client.
LIMITATION OR DISCLOSURE OF YOUR PERSONAL DATA. PROCEDURE FOR ENFORCING ARCO RIGHTS.
You have the right to access your personal data, which we hold and details of the processing of the same; that is, rectify them if they are inaccurate or incomplete, cancel them when you consider that they are not, are required for any of the purposes indicated in this Privacy Notice or are being used, for non-consented purposes or the contractual or service relationship has ended or oppose the processing of the same, for specific purposes.
The mechanisms that have been implemented for the exercise of these rights, which are known as Arco rights, which refer to the rectification, cancellation and opposition of the Owner with respect to the processing of their personal data.

2) Your application must contain the following information:
Name of the owner of the personal data, address or any other means of contact, documents that prove their personality and identity, the clear and precise description of the personal data, any other document that facilitates the location of the data.
3) The deadline to respond to your request is 10 days.
TRANSMISSION OF YOUR PERSONAL DATA.
A3 does not transfer your personal data to third parties without your consent, except in cases where its sole purpose is to comply with the purposes indicated in this privacy notice, as well as those that are permitted by legal provisions that include requests from competent authorities.
MODIFICATIONS TO THE PRIVACY NOTICE. We reserve the right to make modifications or updates to this Privacy Notice at any time, in order to take into account new legislation, internal policies or new requirements for the provision or offer of our services or products.
Therefore, you are obliged to keep this Notice updated, for your consultation. This is in order for the Owner to be able to exercise their ARCO rights and thus keep them informed of any modification by notifying the last email they have provided us.
The parties express that this notice will be governed by the legal provisions applicable in the State of Nuevo León, especially by the provisions of the Federal Law on Protection of Personal Data in Possession of Private Parties.
If you consider that your right to personal data protection has been violated by any conduct of our employees or our actions or responses, you suspect that, in the processing of your personal data, there is a violation of the provisions of the Federal Law on Protection of Personal Data in Possession of Private Parties, you may file a complaint or complaint, corresponding to the National Institute for Access to Information (INAI).
